The short answer is no, but the real answer is YES.
The person you hire should be an attorney that specializes in personal injury. Many attorneys think they can handle a car accident, that it’s easy, but I assure you it is not. Someone who does not specialize will not know all the nuances, be able to protect you from possible liens, or have the ability to maximize your recovery.
One of the things you get when you hire a personal injury attorney is someone who has the experience to handle the initial paperwork to make sure it’s filed on time and with the right company. Then we get to work on the real meat of the case.
Why? Just like in other areas of life, insurance companies are not your friends. They will record all of your statements and, if possible, use weaknesses against you.
Not all accidents result in a claim; however, it is a good idea to speak with an attorney so that you know your rights.
For example, New York is a “no-fault” state. That means that the insurance company of the car you are in pays your medical bills (if you are a pedestrian or bicyclist, the medical bills are paid by the vehicle that hits you). Even in New York, you must file certain papers in a timely fashion in order to secure these rights.
There are many other factors to deal with, and that’s before we get into the compensation for injuries. Even a minor accident can cause injuries – which may evolve over time. A major accident can change your life.
