New York pedestrian injury case

My client was a pedestrian struck by a car. She suffered a badly fractured arm but declined surgery due to a history of anesthesia complications. The case venue was not favorable to plaintiffs (meaning the jury is conservative with money).

To maximize recovery, I made a motion after depositions asking the Court to determine that the car was 100% responsible. I won.

In addition, I paid for a “narrative report” from the doctor treating my client which laid out the injury, treatment, and prognosis as well as limitations of function.

The initial offer on the case was $50,000. Since there was no surgery, the insurance company did not take the injury as seriously as we did. The insurance coverage of the car was $250,000.

After litigation, the motion and the doctor’s report the final offer was $200,000 which we accepted. We allow each case to reach its best possible outcome for the client and we will make every effort to get to that point.
